AGREEMENT FOR USE OF PHOTOGRAPHS FROM THE NATIONAL MONUMENTS RECORD
  1. Use of National Monuments Record ("NMR") Photographs

    The NMR is part of the Historic Buildings and Monuments Commission for England ("English Heritage").

    All information (including photographs) provided from the NMR is supplied by English Heritage in accordance with the terms and conditions of this Agreement to the individual, organisation, or company named in the order form ("You"), for internal purposes or private research. It is supplied in accordance with NMR service standards (information leaflets and price lists available).

    You may not copy or reproduce photographs supplied from the NMR under this Agreement without the NMR's written permission, whether or not the photograph supplied is copyright material.

    The photographs must not be used for purposes which may lead to damage to archaeological sites, historic buildings and landscapes.

  2. Returns policy

    You may cancel your request for photographs up to seven working days after the photographs requested have been delivered to You by notifying us in writing at the address set out below, and obtain a refund of the price paid by You. If You are cancelling because of any problem with the photographs provided please notify us of the problem at the time of cancellation. On cancellation You must return any photographs supplied to You.

  3. Reproduction and Charges

    English Heritage, the Crown, or other licensors are the owners of all rights including copyright and database rights in the photographs. If You wish to reproduce it, or any part of it, You must apply for permission to NMR Enquiry & Research Services at the address below before You carry out any reproduction or publication. Reproduction fees will be payable. The NMR charges reproduction fees as a contribution towards funds for the preservation of items (copies of which are supplied to You) in the NMR archive and administrative costs in providing this service. Where applicable, copyright fees are included within the reproduction fee charged. Where applicable, we may direct You to the relevant copyright holder if we are not authorised to provide photographs on the copyright holder's behalf.
    Warning: Reproduction fees for applications made at short notice or following reproduction/publication are higher than the standard rates due to the need to expedite the application.

  4. Assignment

    Your rights under this Agreement cannot be assigned, transferred, or sub-licensed without the prior written permission of the NMR.

  5. Breach

    Failure to comply with the terms of this Agreement by You will be construed as a material breach of them, and will result in the immediate termination of the Agreement. NMR may, where appropriate, seek compensatory damages from You and/or the return of any photographs supplied under this Agreement.

  6. Disclaimer

    English Heritage gives no warranties in connection with the photographs (including supporting information) provided to You pursuant to this Agreement including in relation to its completeness and/or accuracy. English Heritage cannot be held responsible for any decisions made in reliance on the information.

  7. Jurisdiction

    This Agreement shall be governed by the laws of England and subject to the exclusive jurisdiction of the English courts.
